Agreement to Terms

By accessing or using the services provided by Randy Wimbley's Training Academy ("Instructor," "we," "our," or "us"), you ("Student," "you," or "your") agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services or book our classes.

Services Description

We provide firearms training and education services, including but not limited to:

• Concealed carry permit (CPL/CCW) courses
• Basic firearms safety courses
• Advanced firearms training
• Private instruction
• Qualification shoots and certifications

Eligibility Requirements

To participate in our courses, you must:

• Meet the minimum age requirement (typically 21 years old for concealed carry courses, 18 for basic courses)
• Be legally eligible to possess firearms under federal and your state law
• Not be prohibited from possessing firearms due to:
  • Felony convictions
  • Certain misdemeanor convictions
  • Mental health adjudications
  • Restraining orders or domestic violence convictions
  • Other disqualifying factors under 18 U.S.C. § 922(g)
• Provide valid government-issued photo identification
• Complete any required background checks

By booking a class, you represent and warrant that you meet all eligibility requirements.

Booking and Payment

Class Registration

• All bookings must be made through our online booking system or by contacting us directly
• A booking confirmation will be sent to your email
• Your spot is reserved upon payment confirmation

Payment Terms

• Full payment is required at time of booking unless otherwise specified
• Some courses may require a deposit with balance due before class date
• Payments are processed securely through Stripe
• We accept credit cards, debit cards, and other payment methods as displayed

Pricing

• Class prices are clearly displayed at time of booking
• Prices may vary based on:
  • Course type and duration
  • Class size
  • Location
  • Additional services (firearm rental, ammunition, etc.)
• Additional fees may apply for:
  • Range fees (if not included)
  • Ammunition (if not included)
  • Firearm rental
  • Background check fees
  • Certificate processing

All prices and fee structures are disclosed before booking.

Class Policies

Attendance

• Students must arrive on time for the scheduled class start
• Late arrivals may be denied entry to maintain class integrity
• Attendance for the full duration is required for certificate issuance
• Missed portions of class may result in non-completion

Conduct and Safety

Students must:

• Follow all safety instructions and range rules
• Treat firearms with respect and care
• Follow all commands from the instructor immediately
• Behave respectfully toward the instructor and other students
• Not attend class under the influence of alcohol or drugs
• Not handle firearms while impaired in any way

Disqualification

We reserve the right to remove any student from class without refund for:

• Unsafe handling of firearms
• Failure to follow instructor commands
• Disruptive or disrespectful behavior
• Attending class under the influence
• Violation of range rules or safety protocols
• Providing false information on registration

Assumption of Risk and Liability Waiver

Inherent Risks

Firearms training involves inherent risks, including but not limited to:

• Risk of injury from firearms discharge
• Risk of hearing damage (hearing protection required)
• Risk of injury from ricochets or ejected casings
• Risk of allergic reactions to gunpowder residue
• Physical exertion and environmental exposure

Voluntary Participation

By participating in our courses, you acknowledge that:

• You are voluntarily participating with full knowledge of the risks
• You assume all risks associated with firearms training
• You have adequate health and physical fitness to participate
• You will immediately inform the instructor of any health concerns or limitations

Release of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU RELEASE AND HOLD HARMLESS Randy Wimbley's Training Academy, its instructors, employees, agents, and affiliates from any and all claims, liabilities, damages, or expenses (including attorney's fees) arising from:

• Your participation in firearms training
• Use of our facilities or equipment
• Actions or omissions of other students
• Any injuries sustained during training

Exceptions

This waiver does not apply to:

• Gross negligence or willful misconduct by the instructor
• Violations of applicable firearms safety regulations
• Failures to provide required safety equipment

Firearms and Ammunition

Bring Your Own Firearm

If bringing your own firearm:

• Firearms must be unloaded during transport
• Ammunition must be stored separately
• Firearms must be in safe working condition
• You are responsible for safe handling and transport

Firearm Rental

If renting a firearm:

• You must meet all legal requirements to handle firearms
• Rental firearms are provided for in-class use only
• You are responsible for any damage beyond normal wear and tear
• All safety rules apply to rental firearms

Ammunition

• Use only ammunition approved by the instructor
• Do not bring reloaded or hand-loaded ammunition without prior approval
• Ammunition must be appropriate for your firearm
• We are not responsible for malfunctions due to improper ammunition

Certification and Completion

Requirements for Certificate

To receive a completion certificate:

• Attend the full duration of the class
• Demonstrate safe firearm handling
• Pass any required written tests
• Complete live-fire qualification (if applicable)
• Meet all state requirements for the specific course

Certificate Issuance

• Certificates are issued upon successful completion
• Certificates may be digital and/or printed
• Duplicate certificates may be available for a fee
• We maintain records as required by your state law

No Guarantee of Permit Approval

IMPORTANT: Completion of our course does not guarantee:

• Approval of your concealed carry permit application
• Ability to purchase firearms
• Clearance of background checks

Permit approval is at the sole discretion of the issuing authority in your jurisdiction.

Intellectual Property

All course materials, including:

• Handouts and written materials
• Presentations and training videos
• Photographs and images
• Curriculum and instructional content

Are the intellectual property of Randy Wimbley's Training Academy or used with permission. You may not:

• Reproduce or distribute materials without permission
• Use materials for commercial purposes
• Modify or create derivative works

Photography and Media Release

By attending our classes, you consent to:

• Being photographed or recorded during training (excluding live-fire exercises for safety)
• Use of your image in marketing materials, website, and social media
• Publication of your testimonials or reviews (with your permission)

If you do not consent to being photographed, please notify us in writing before class.

Legal Compliance

Not Legal Advice

IMPORTANT: Our training provides education on firearms laws but:

• We do not provide legal advice
• You should consult an attorney for legal questions
• Laws vary by jurisdiction and change frequently
• You are responsible for knowing and complying with all applicable laws

Your Responsibilities

You are responsible for:

• Complying with all federal, state, and local firearms laws
• Obtaining any required permits or licenses
• Properly storing and securing firearms
• Ensuring you are not prohibited from possessing firearms
• Staying informed of changes to firearms laws

your state Law Compliance

This agreement is governed by the laws of your state. Our training complies with:

• your state firearms training requirements
• your state concealed carry permit regulations
• Applicable federal firearms regulations

Privacy

Your personal information is collected, used, and protected in accordance with our Privacy Policy. By using our services, you consent to our privacy practices.

Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective:

• Upon posting on our website for new bookings
• With notice to existing bookings if materially affecting their class

Continued use of our services after changes constitutes acceptance of modified terms.

Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Entire Agreement

These Terms of Service, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and Randy Wimbley's Training Academy regarding our services.
