Transportation of Firearms in North Dakota

North Dakota's transportation rules are primarily governed by N.D.C.C. Title 62.1 and the federal Firearm Owners Protection Act (FOPA), 18 U.S.C. 926A. The transportation analysis turns on (1) who is transporting, (2) the loaded/unloaded condition of the firearm, (3) whether the journey is intrastate or interstate, and (4) any sensitive destinations along the route.

Intrastate Transportation - Inside North Dakota

For ordinary travel inside North Dakota, the rules are the same as vehicle-carry rules under N.D.C.C. 62.1-04-01:

• CWL holders (Class 1 or Class 2): May transport a loaded, concealed firearm in a vehicle anywhere they have lawful authority to carry.
• Constitutional carriers (ND residents): May transport a loaded, concealed firearm in a vehicle under N.D.C.C. 62.1-04-01(2), subject to the duty to inform law enforcement on contact.
• Recognized out-of-state permit holders: May transport a loaded, concealed firearm in a vehicle on the same terms as a ND CWL holder.
• Persons without authority to carry concealed: Must transport unloaded under N.D.C.C. 62.1-04-01; the chamber must not contain a loaded shell, and revolver cylinders must contain no loaded shells. Best practice is to also separate the firearm and ammunition, store in a locked container, and place in the trunk or other inaccessible location.

Interstate Transportation - 18 U.S.C. 926A (FOPA)

FOPA protects interstate transportation through states where the traveler does not otherwise have lawful carry authority. The protection applies if all of the following conditions are met:

1. The traveler may lawfully possess and carry the firearm at the origin point.
2. The traveler may lawfully possess and carry the firearm at the destination.
3. During transportation, the firearm is unloaded, AND
4. The firearm is not directly accessible from the passenger compartment.
5. If the vehicle has no separate trunk, the firearm and ammunition must be in a locked container other than the glove compartment or console.

FOPA preempts state and local restrictions for travelers passing through. However:

• FOPA protects "transportation," not "stops." A traveler who stops, takes the firearm out, attends a social or commercial event, or otherwise interrupts the journey may lose FOPA protection.
• Some states (notably New York, New Jersey, Maryland) have been aggressive in prosecuting alleged FOPA violations. Document the journey (route, timing) and be prepared to demonstrate compliance.

Transportation by Common Carrier (Bus, Train)

ND state law does not generally restrict firearms transportation by commercial bus or train operators, but the carrier's policy controls access to the firearm during the trip. Most carriers prohibit firearms in carry-on baggage or on the carrier's person and require declaration and stowage in checked baggage.

Always verify the specific carrier's policies before traveling. Greyhound, Amtrak, and other commercial carriers each maintain their own firearms-transportation requirements.

Air Travel - TSA and 18 U.S.C. 922 / 49 C.F.R. 1540

Federal law and TSA regulations control air travel with firearms. Key requirements:

• Firearms must be unloaded.
• Firearms must be in a locked, hard-sided container.
• The container must be checked as baggage, not carried on.
• The traveler must declare the firearm at the airline check-in counter.
• Ammunition must be in original packaging or a dedicated ammunition container, and is generally allowed in the same locked hard-sided container as the firearm (per TSA) or in a separate container.
• The firearm and ammunition cannot be present in the sterile area of an airport (carry-on bag, on person past security). Carrying a firearm into the TSA sterile area is a federal crime under 49 U.S.C. 46505 and may also be charged under 18 U.S.C. 930.
• Each airline has its own additional requirements. Verify the airline's policy in advance.

If your travel plans include layovers in different states, you must comply with both states' laws and the airline's policies. A ND CWL is not a substitute for compliance with airline and federal aviation rules.

Transportation to a Shooting Range, Hunting Site, or Firearms Class

Travel for the explicit purpose of:

• Lawful target shooting at a range.
• Lawful hunting (with the appropriate licenses).
• Attending a firearms training course.

is treated under ND law in the same way as ordinary transportation. Persons without authority to carry concealed should transport the firearm unloaded under N.D.C.C. 62.1-04-01.

Hunting note: Under ND game and fish regulations, an individual engaged in the lawful hunting of big game or small game may not keep or carry a loaded firearm in or on any motor vehicle, including OHVs and snowmobiles. Unload before re-entering the vehicle.

Transportation Across Tribal Lands

Indian Country in North Dakota (Standing Rock, Spirit Lake, Turtle Mountain, Three Affiliated Tribes, etc.) is subject to tribal jurisdiction for some matters and federal jurisdiction for others. Tribes may impose firearms restrictions on tribal members and non-members alike on tribal lands. ND's CWL and constitutional carry have no automatic effect on tribal land.

Before traveling on or through tribal lands:

• Identify the tribal nation's current firearms rules.
• Recognize that tribal law enforcement may have jurisdiction independent of state and federal authority.
• When in doubt, transport under FOPA-equivalent conditions (unloaded, locked, inaccessible).

Transportation to Federal Facilities

A firearm being transported in a personal vehicle to a federal facility (e.g., a national park, federal courthouse, federal building, post office, military installation) generally violates 18 U.S.C. 930 if brought onto the property. Federal restrictions extend to parking areas of many federal buildings. Identify destination-specific rules in advance.

Transportation by Persons Subject to Court Order or Other Restrictions

A person subject to:

• A domestic-violence protection order meeting 18 U.S.C. 922(g)(8),
• A restraining order that prohibits firearm possession,
• A bond condition prohibiting firearms,

may not transport firearms during the pendency of the order. Surrender or transfer obligations may apply (see Red Flag section).

Transportation of NFA Items

NFA items (machine guns, SBRs, SBSs, suppressors, destructive devices, AOW) follow special transportation rules:

• Interstate transportation of a machine gun, SBR, SBS, or destructive device requires ATF Form 5320.20 approval in advance.
• Interstate transportation of a suppressor or AOW does not require Form 5320.20 approval (per ATF interpretation), but compliance with all destination-state laws is required.
• Always carry the approved ATF Form 4 (or equivalent transfer document) for the NFA item during transportation.

Storage in Vehicle During Travel

A firearm in a vehicle parked in a public place is exposed to theft risk and may also implicate storage rules in some jurisdictions. Best practice:

• Use a vehicle gun safe anchored to the vehicle frame.
• Avoid leaving firearms in unattended vehicles overnight when possible.
• If a stop at a federal facility is required, secure the firearm in the vehicle in a locked container before approaching the facility - check posted signage for parking-area restrictions.

Practical Transportation Checklist

• Confirm your legal status at every state along the route (CWL, constitutional carrier, recognized permit, or unauthorized).
• If unauthorized to carry: transport unloaded, locked, inaccessible under FOPA.
• Pack firearms separately from ammunition when feasible.
• Carry your license if you have one; carry ID in all cases.
• Plan for prohibited places along the route and at the destination.
• Recognize that stops can affect FOPA protection.
• For air travel, follow TSA and airline requirements to the letter.
• For tribal lands and federal facilities, identify destination-specific rules in advance.
