The Nebraska Attorney General's Office determines which states' concealed handgun permits (CHPs) Nebraska will recognize, based on whether those states have standards equal to or greater than Nebraska's.
Since August 30, 2009, Nebraska has recognized out-of-state concealed handgun permits from approved states, but only for non-residents of Nebraska. Nebraska residents must obtain a Nebraska Concealed Handgun Permit - they cannot rely on an out-of-state permit to carry concealed in Nebraska.
Governing authority: Nebraska Concealed Handgun Permit Act, Neb. Rev. Stat. §§ 69-2427 to 69-2447, with the conditional-recognition rule for out-of-state permits codified at Neb. Rev. Stat. § 69-2448. The official list of recognized states is maintained by the Nebraska State Patrol at https://statepatrol.nebraska.gov/services/concealed-handgun-permits/nebraska-reciprocity.
LB 77 (2023, effective September 2, 2023) established constitutional (permitless) concealed carry under Neb. Rev. Stat. § 28-1202.01 for any person aged 21 or older who is not a prohibited person. After LB 77, non-residents 21+ who are not prohibited persons may carry a concealed handgun in Nebraska without a permit regardless of reciprocity, subject to the prohibited-locations list at Neb. Rev. Stat. § 28-1202.01(3). The Nebraska CHP and the reciprocity framework remain relevant for: (1) Nebraska residents who want a reciprocity-bearing credential for travel; and (2) non-residents under 21 who hold a permit from a recognized state and seek the federal prohibited-persons clearance the CHP provides.
Nebraska will honor a concealed handgun permit issued by another state only if all of the following are true:
"As of August 30, 2009, Nebraska will recognize CHP permits issued by those states on the below list which the Nebraska Attorney General has determined have standards equal to or greater than Nebraska. This recognition extends ONLY to persons who are NOT residents of Nebraska." - Nebraska State Patrol
Non-resident permit holders from approved states may carry concealed handguns in Nebraska to the same extent as Nebraska permit holders. The Nebraska State Patrol directs permit holders to "see our regulations on this website for restrictions on places where a concealed weapon can be carried." Consult the Nebraska State Patrol's published regulations for the current list of prohibited locations before carrying in Nebraska.
Source of truth: Because the approved-states list changes periodically as state laws are updated, permit holders should consult the Nebraska State Patrol's reciprocity page before travel for the current list of approved and not-approved states.
A number of states currently recognize the Nebraska Concealed Handgun Permit. Because other states' laws can change without notice, the Nebraska State Patrol advises:
"In order to ensure a state's laws haven't changed, contact the state directly to inquire about reciprocity with Nebraska's Concealed Handgun Permit law."
Before carrying concealed in another state under a Nebraska permit, verify reciprocity directly with that state's attorney general or state police.
If you move to Nebraska holding a valid permit from a state Nebraska recognizes for reciprocity purposes, you receive a significant benefit when applying for a Nebraska CHP:
"A valid permit from another state that is recognized by Nebraska for reciprocity purposes will allow you to apply immediately and the 180 day residency requirement will be waived. All other application requirements still apply including the application fee, background check, handgun training and safety course, and all other applicable documentation."
